Trademarks and Recycled Plastic!...


While browsing Twitter today, I came across a tweet by @healthebay which mentioned that the L.A. Galaxy soccer team recently wore jerseys made from recycled ocean plastic!

Wow!

This is wonderful news, of course, because it brings more attention to the fight against ocean pollution.

It also turns out that the brand of clothing behind this venture is PARLEY®.



A quick search of the Trademark Database at uspto.gov revealed at least one trademark registration for clothing for the mark, PARLEY®, as shown below, associated with this environmental friendly team jersey.

#EarthDay2017 At The Beach...

Gotta love all those #stickers!  Lots of trademarks there!...  Do you recognize some of these action sports trademarks represented by stickers?...



#BeachTrash is a fact of life near the water's edge in both Santa Monica and Venice, unfortunately, and the agencies responsible for its clean up have dropped the ball and it accumulates day after day... Shown below are a couple of crushed aluminum cans, an empty orange colored pack of PALL MALL® cigarettes, and a green plastic medical marijuana container...  (x-ref: #trademarks as #beachtrash).

Unlicensed vendors selling cheap styrofoam body boards covered in cheap nylon fabric and that break easily in the surf, as well as umbrellas, are a staple at Santa Monica State Beach.  The umbrellas are decent but the styrofoam body boards are a nuisance and should be more heavily monitored and confiscated by the police.  They are a danger to those who use them because they can easily break in the surf and as a result thereof can strand someone in the ocean who really should not be there in the first place because they are often non-swimmers...

In the foreground, as well, is typical #beachtrash often present near the world famous Santa Monica Pier that the City of Santa Monica does not pick up or dispose of on either a daily or regular basis.

Spring Break 2017: #Trademarks & #BeachTrash

Today's post features numerous branded goods and their trademarks.  Unfortunately, the brands photographed have morphed into #beachtrash on Santa Monica State Beach as the result of two contributing factors, namely:

1.  the purchasers of these products have discarded these items on the beach instead of throwing them away in a nearby trash container; and

2.  the City of Santa Monica continues not to hand pick and/or otherwise dispose of this #beachtrash near the water's edge on either a daily or regular basis.

Here are just some of the trademarks I observed yesterday afternoon, Monday, April 10, 2017 at and after 4 pm... Some of these discarded items are in their second day on the sand and others apparently discarded that day.

We begin with a world famous trademark for alcoholic beverages, namely, BACARDI®


Below, an empty discarded plastic bottle of DASANI® water...


An empty PEPSI® paper cup...

An empty glass bottle of CORONA® beer

#Trademarks & #BeachTrash:  I would much rather not have to discuss the after lives of branded product on the beaches of Santa Monica but since I am a trademark attorney and an advocate of clean and safe beaches, it was a natural fit to combine the two topics as they collide on the sand here in sunny Southern California...

Each of the trademarks presented are protected by U.S. trademark registrations and in some cases by registrations overseas.  Having a registration maximizes the owner's ability to enforce their rights with respect to their trademarks.

Going to the Beach?  If you were planning on going to the beach in Santa Monica, California during Spring Break, you should know in advance that you will likely encounter a great deal of #beachtrash near the water's edge.  It's both sad and unfortunate given that the City of Santa Monica does have the resources to clean it up on a daily basis but chooses not to do so.  That the City is able to collect its exorbitant beach parking fees seven days a week is a testament to this City's civic priorities which apparently cares more about revenue than public safety.
