Trademarks In The Sun, Sand & Surf...








Surfboards, swim fins, sunscreen, sandals, umbrellas, beach chairs, t-shirts, swim suits, hoodies, sunglasses... sounds like stuff you see at the beach, right?!...

Dateline: Summer 2017 is in full swing and any day at the beach will reveal numerous commercial brand names in use on all kinds of products like those highlighted above. These product names are protected by trademarks. In the United States, trademark rights are acquired through use.  Maximum protection, however, is available with a U.S. Federal Trademark Registration.  Relying on your common law rights of use will be limited to the geographic range of your use.
